New Mexico Family Law Appeals Attorney
Appealing a court decision, or appellate work, is usually the most challenging work law firms perform.
Family Law Appeals occur when a party unhappy with the outcome of a court decision decides to appeal. However, most laymen do not understand that Appellate courts do not retry cases or hear new evidence. Appeals are granted only if there is evidence that an incorrect ruling occurred due to a misinterpretation of the law, misapplication of a law, unlawful admission of evidence or lack of evidence to support a ruling. Mounting a successful appeal requires a careful review of the trial court records for errors of law or wrongful decisions on the facts by the court. WFL prepares a brief for the Appellate Court and presents an oral argument, if required.
